If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

Linkonvert is an AI-powered conversational platform that enables businesses to transform any URL into an intelligent, automated sales conversation. Our Service includes, but is not limited to:

• AI-powered chatbot creation and deployment across multiple messaging channels
• Lead capture, qualification, and scoring automation
• Multi-channel conversation management (WhatsApp, Instagram, Facebook Messenger, Web Chat)
• AI appointment booking and calendar integrations
• Campaign management including outbound messaging and comment-to-DM automation
• Analytics dashboard and performance reporting
• Third-party integrations via webhooks, API access, and native connectors
• AI training and optimization tools for conversation improvement

We reserve the right to modify, update, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

3. Account Registration & Security

To use Linkonvert, you must create an account by providing accurate, current, and complete information. You agree to:

• Provide truthful and accurate information during registration and maintain updated account details
• Keep your account credentials confidential and not share them with unauthorized individuals
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• Not create multiple accounts for the purpose of circumventing usage limits or restrictions

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity. You must be at least 18 years old or the age of majority in your jurisdiction to create an account.

4. Subscriptions & Payments

4.1 Pricing & Plans

Linkonvert offers multiple subscription plans (Starter, Growth, and Pro) with varying features and pricing. Current pricing is displayed on our website and is subject to change with 30 days' prior notice to existing subscribers.

4.2 Billing

Subscriptions are billed on a monthly recurring basis. Payment is due at the beginning of each billing cycle. All fees are quoted in US Dollar (USD) unless otherwise stated. We accept major credit cards, debit cards, and other payment methods as displayed during checkout.

4.3 Credits & Usage

Each plan includes a specified number of monthly credits. Unused credits do not roll over to subsequent billing periods. Additional credits may be purchased separately at the rates displayed on our platform.

4.4 Money-Back Guarantee

All new subscriptions include a 14-day money-back guarantee. If you are not satisfied with the Service within the first 14 days of your subscription, you may request a full refund by contacting our support team. Refund requests made after 14 days are handled on a case-by-case basis.

4.5 Cancellation

You may cancel your subscription at any time through your account dashboard. Upon cancellation, your access will continue until the end of the current billing period. No partial refunds are provided for unused portions of a billing period (outside the 14-day guarantee window).

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service to:

• Send spam, unsolicited messages, or engage in any form of unauthorized bulk messaging
• Distribute malware, viruses, or any harmful software or content
• Engage in phishing, fraud, scams, or any deceptive practices
• Violate any applicable local, state, national, or international laws or regulations
• Infringe upon the intellectual property rights of any third party
• Harass, threaten, defame, or discriminate against any individual or group
• Collect personal data from end users without proper consent and legal basis
• Attempt to reverse-engineer, decompile, or disassemble any aspect of the Service
• Interfere with or disrupt the Service's infrastructure, servers, or networks
• Resell, redistribute, or sublicense the Service without written authorization

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without notice or refund.

6. Intellectual Property

All content, features, functionality, software, designs, trademarks, and other intellectual property associated with the Service are owned by Linkonvert and are protected by applicable intellectual property laws.

You retain ownership of all content, data, and materials you upload to or create through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and display your User Content solely for the purpose of providing and improving the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology without express written permission from Linkonvert.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information and the data processed through our platform.

You are responsible for ensuring that your use of the Service complies with all applicable data protection laws and regulations in your jurisdiction, including but not limited to Malaysia's Personal Data Protection Act 2010 (PDPA), the EU's General Data Protection Regulation (GDPR), and any other applicable privacy laws.

8. Third-Party Integrations

The Service may integrate with or provide access to third-party platforms, services, and applications (including WhatsApp, Instagram, Facebook Messenger, ManyChat, GoHighLevel, Zapier, and others). Your use of such third-party services is subject to their respective terms and policies.

Linkonvert is not responsible for the availability, accuracy, or conduct of any third-party services. We do not endorse and are not liable for any damages arising from your use of third-party integrations.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Linkonvert and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to Linkonvert during the twelve (12) months immediately preceding the event giving rise to the claim.

The Service is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Service's reliability, accuracy, availability, or fitness for a particular purpose.

10. Termination

Either party may terminate this agreement at any time. You may terminate by canceling your subscription and closing your account. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service, other users, or our business.

Upon termination, your right to use the Service ceases immediately. We will retain your data for a period of 30 days following termination, during which you may request data export. After this period, your data will be permanently deleted from our systems.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through email notification or a prominent notice on our platform at least 30 days before they take effect. Your continued use of the Service after the effective date of modified Terms constitutes acceptance of those changes.

If you do not agree with any modified terms, you must discontinue use of the Service and cancel your subscription before the changes take effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
